I personally am familiar with the tactics employed by agencies like CTU and Jack didn't have to kill Curtis to diffuse that situation. It does make for great drama to have people thinking he did, but I propose he shot him in the collarbone, perhaps in a pre-arranged scenario between himself and Curtis! something to think about, isn't it?
